NEWSLETTER
The Site offers the User the opportunity to subscribe to newsletters. The newsletter provides the User periodically with information about EgleArt services. To receive the newsletter, EgleArt requires a valid email address. EgleArt will review the email address provided for the purpose of determining whether the User is, in fact, the owner of the email address provided or whether the actual owner of said address is authorised to receive the newsletter. When subscribing to Egle Art’s newsletter, your IP address, as well as the date and time of subscription, will be stored. This serves to protect Egle Art in the event a third party improperly and without EgleArt knowledge makes use of the User’s email address to subscribe to the newsletter. EgleArt will not collect any other data. The data thereby collected is used solely for the purpose of receiving the newsletter. No data is transferred to third parties. The User may cancel their subscription to the newsletter at any time. The User will find additional details in the email confirming the User’s subscription as well as in each newsletter.
CONTACTING EgleArt
On the Site, the User has the ability to contact EgleArt either by email and/or by using a contact form. In such event, information provided by the User is stored for the purpose of facilitating communications with the User. No data is transferred to third parties. Nor is any of this information matched to any information that may be collected by other components of the Site.
POSTING COMMENTS
On the Site, EgleArt offers the User the opportunity to post comments about individual articles. For this purpose, the IP address of the User/internet connection subscriber is stored. This information is stored for EgleArt security in the event the author through his/her comments infringes against third party rights and/or unlawful content is entered. Consequently, EgleArt has a direct interest in the author’s stored data, particularly since EgleArt may be potentially liable for such violations. No data is transferred to third parties. Nor is any of this information matched to any information that may be collected by other components of the Site.
USE OF GOOGLE ANALYTICS WITH ANONYMISATION
The Site uses Google Analytics, a web analysis service from Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter referred to as “Google“. Google Analytics employs so-called “cookies“, text files that are stored on the User’s computer in order to facilitate an analysis of the User’s use of the Site.
The information generated by these cookies, such as time, place and frequency of the User’s visits to the Site, including IP address, is transmitted to Google’s location in the US and stored there.
EgleArt uses Google Analytics with an IP anonymisation feature on the Site. In doing so, Google abbreviates and thereby anonymises the User’s IP address before transferring it from member states of the European Union or signatory states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there.
Google states that it will never associate the User’s IP address with other data held by Google. The User can prevent cookies from being installed by adjusting browser settings accordingly. The User should be aware, however, that by doing so some functionality of the Site may be limited.
EgleArt’s legitimate interest in data processing also lies in these purposes. The legal basis for the use of Google Analytics is § 15 para. 3 TMG and Art. 6 para. 1 lit. f GDPR. The data sent by EgleArt and linked to cookies, user-identifiers (e.g. User-IDs) or advertising-identifiers are automatically deleted after 14 months. Data whose retention period has been reached is automatically deleted once a month. Google also offers a disabling option for the most common browsers, thus providing the User with greater control over the data which is collected and processed by Google. If the User enables this option, no information regarding the User’s visit to the Site is transmitted to Google Analytics. However, the activation does not prevent the transmission of information to EgleArt or to any other web analytics services EgleArt may use. Alternatively, the User can disable the future analysis of the User’s visit to the Site by Google Analytics, by “clicking” on the link below. By clicking on the link, a so-called “opt-out cookie” is configured, which means that the analysis of the User’s visit to the Site will be prevented in the future:

Please note that deleting cookies in the browser settings, may also delete the opt-out cookie and its re-activation may become necessary.
Use of reCAPTCHA
In order to protect input forms on the Site, EgleArt uses the “reCAPTCHA” service of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter “Google.” By means of this service, it can be distinguished whether the corresponding input is of human origin or is created improperly by automated machine processing.
To EgleArt’s knowledge, the referrer URL, the IP address, the behaviour of the website visitors, information about the operating system, browser and length of stay, cookies, display instructions and scripts, user input behaviour and mouse movements in the “reCAPTCHA” checkbox are conveyed to “Google”.
Google uses the information obtained, among other things, to digitise books and other printed matter as well as to optimise services such as Google Street View and Google Maps (e.g. house number and street name recognition).
The IP address provided as part of “reCAPTCHA” is not merged with other data from Google unless the User is logged into their Google Account at the time the “reCAPTCHA” plug-in is used. If the User wants to prevent this transmission and storage of data by “Google” about the User and their behaviour on the Site, the User must log out of “Google” before their visit the Site or before using the reCAPTCHA plug-in.

USE OF PINTEREST
The site employs the services of pinterest.com. Pinterest.com is a service of Pinterest, Inc., 808 Brannan St, San Francisco, CA 94103, USA. Through the “Pin it“ button integrated into the Site, Pinterest is informed that the User has accessed that particular page of the Site. If the User is logged into Pinterest, Pinterest can associate the User’s visit to the Site with the User’s Pinterest account and thereby create a link to the data collected. Pinterest stores the data that is transferred through clicks on “Pin it“ buttons. More information with respect to the purpose and extent of data collected, how it is processed and used as well as the User’s rights in this regard and what settings can be used to protect the User’s privacy by consulting the Pinterest data protection policy, can be accessed at http://pinterest.com/about/privacy/.
To prevent Pinterest from associating the User’s visit to the Site to their Pinterest account, the User must first log out of their Pinterest account before visiting the Site.
NEWSLETTER TRACKING
EgleArt’s newsletter includes so-called web bugs that allow EgleArt to recognise if and when an email has been opened and which links in the email have been clicked by its recipient.
This data is stored so that EgleArt can best align the newsletter to the wishes and interests of the subscribers. Accordingly, the data thus collected is used to send personalised newsletters to each recipient.
The User will be asked to consent to the use of their personal data as follows:
“I agree that my data and my user responses will be stored electronically by newsletter tracking so that I can receive a personalised newsletter. The revocation of the consent to receive the newsletter constitutes a revocation of the consent for the tracking described above.”
By revoking the consent to receive the newsletter, the consent to the aforementioned tracking is revoked.
THE USE OF INSTAGRAM
EgleArt promotes the service Instagram on the Site. Instagram is a service of Instagram Inc. By means of the integrated “Insta” button on the Site, Instagram receives the information that the User has accessed the corresponding page of the Site. If the User is logged into Instagram, Instagram may assign the visit to the Site to their Instagram account and link the data by this means. The data transmitted by clicking the “Insta” button is stored by Instagram. The User can find more information regarding the purpose and scope of data collection, its processing and use, as well as your related rights and settings options for protecting your privacy in the Instagram data protection notice under https://help.instagram.com/155833707900388.
To prevent the User’s visit to the Site from being accessed by their Instagram account, they must log out of their Instagram account before visiting the Site.
USING PAYPAL AS A PAYMENT METHOD
If, while completing an order, the User decides to use PayPal as an online payment service, their contact details will be sent to PayPal during the order process. PayPal is a service from PayPal (Europe) S.à.rl & Cie. SCA, 22-24 Boulevard Royal, L-2449 Luxembourg. PayPal assumes the function of an online payment service and trustee and offers buyer protection services.
The personal data transmitted to PayPal usually includes your first name, last name, address, telephone number, IP address, e-mail address, or other data required to process the order, such as the number of articles ordered, the article number, invoice amount, percentage taxes and invoice details, etc.
This information needs to be transferred to process the order using the User’s chosen payment method, mainly in order to confirm their identity and manage their payment and the customer relationship.
Please note the following, however: PayPal may also pass on the User’s personal data to subcontractors or other affiliates, to the extent necessary for fulfilling the contractual obligations arising from the User’s order or for processing personal data in their order.
Depending on the payment type the User pre-select in their PayPal account, which may include payment by invoice or direct debit, PayPal will transfer the personal data transferred to PayPal to credit agencies. The information transferred serves to identify the User and to verify their creditworthiness with regard to the order placed. USING DIRECT TRANSFER AS A PAYMENT METHOD
Our Payment Service Provider is Sage Pay (formerly Protx) – the largest independent payment service provider (PSP) in the UK and Ireland.
Sage Pay provides a secure payment gateway (Level 1 PCI DSS), processing payments for thousands of online businesses, including ours. It is Sage Pay’s utmost priority to ensure that transaction data is handled in a safe and secure way.
Sage Pay uses a range secure methods such as fraud screening, I.P address blocking and 3D secure. Once on the Sage Pay systems, all sensitive data is secured using the same internationally recognised 256-bit encryption standards.
Sage Pay is PCI DSS (Payment Card Industry Data Security Standard) compliant to the highest level and maintains regular security audits. They are also regularly audited by the banks and banking authorities to ensure that their systems are impenetrable.
Sage Pay is an active member of the PCI Security Standards Council (PCI SSC) that defines card industry global regulation.
